RGR Power Washing – Terms & Conditions

Effective Date: 1/26

These Terms & Conditions apply to all services provided by RGR Power Washing (“Company”) to the client (“Client”). Approval of an estimate, proposal, invoice, scheduling of service, or signing of any agreement constitutes acceptance of these Terms and forms a legally binding contract.

1. Legally Binding Agreement

By approving an estimate or signing a contract with RGR Power Washing, Client enters into a legally binding agreement for services to be completed at the agreed-upon price and scope.

2. Scope of Work

Services are limited strictly to those described in the written estimate or proposal. Any additional services not listed require written approval and may result in additional charges.

3. Estimates & Acceptance

Estimates are valid for 30 days unless otherwise stated.
Acceptance may occur via digital signature, email, text message, verbal approval, or payment.
Digital communications and electronic signatures are legally binding.

4. Scheduling & Weather

Scheduling is dependent on weather and site conditions.
Inclement weather or unsafe conditions may delay or reschedule service.
Graffiti removal is typically scheduled for morning hours and may require multiple visits.
Weather-related delays do not constitute breach of contract.

5. Cancellations & Rescheduling

Cancellations within 48 hours of scheduled service may incur a fee.
Same-day cancellations may be charged up to the full service amount.

6. Water Usage

Client agrees to provide access to an on-site water supply via outdoor spigot at no cost unless otherwise noted in the estimate.

Client is responsible for ensuring water is on, functional, and accessible.
Hose must be removable from the hose bib.
If water pressure or volume is limited, Client agrees to cease indoor water use during service.
If water is unavailable at time of service and no alternative source was contracted, a $75 rescheduling fee will apply.

Graffiti Removal (Philadelphia & Urban Areas):

If water usage is required, this will be clearly noted in the estimate. If not noted, the Company will supply water at no additional cost.

7. Electrical Usage

Client agrees to provide access to an on-site electrical source if required, at no cost.

8. Access, Courtesy & Safety

Client is responsible for keeping children, pets, and bystanders away from work areas during service.
Children and pets must remain off treated surfaces for 24 hours after completion.
Client must provide clear access to all work areas.

9. Removal of Personal Property

Removal and replacement of grills, deck furniture, planters, and other items are the Client’s responsibility.

If the Company must move items, it is not responsible for damage or storage issues.
Additional charges may apply for time and labor.

10. Property Condition & Watertightness

Client affirms the property is in good repair and watertight, including:

Doors and windows
Electrical fixtures and outlets

The Company is not responsible for water intrusion caused by improper installation, maintenance, or pre-existing defects.

11. Windows & Glass

Window cleaning is not included unless listed as a line item.
Windows may become water spotted after service.
The Company is not responsible for “fogging” caused by failed window seals.

12. Payments & Collections

Payment is due upon completion unless otherwise agreed in writing.
Accepted payment methods include cash, check, credit/debit card, Venmo, and PayPal.
Late payments are subject to interest of 2% per month beginning day 31.

The Client agrees to pay all collection costs, legal fees, and court costs incurred.

Mechanic’s Lien:

The Company reserves the right to file a mechanic’s lien for non-payment. A notice of intent will be sent via registered mail after 30 days past due.

13. Product Warranties

All warranties are limited to those offered by product manufacturers. The Company makes no additional warranties, express or implied. Any concerns regarding work must be reported immediately.

14. Pre-Existing Damage & General Liability

The Company is not responsible for damages resulting from pre-existing or latent conditions, including but not limited to:

Improperly installed siding, shingles, windows, doors, or gutters
Wood rot, defective construction, loose wiring, poor caulking
Loose mortar or failing masonry

Cleaning may reveal underlying defects previously concealed by dirt, oxidation, or organic growth.

15. Surface & Material Limitations

Wood:  Natural variation, aging, density differences, and weathering may cause uneven appearance. Exact color matching is not guaranteed.

Concrete:  Cleaning reveals imperfections present from the original pour or curing process. Uniform appearance is not guaranteed.

Stone:  The Company removes growth and debris only and is not a stone mason. Natural variation will remain.

Siding:  Oxidation, fading, and chalking may become more visible after cleaning. These are not damages caused by cleaning.

Stains:  Some stains cannot be removed. No guarantee is made unless explicitly stated.

16. Graffiti Removal

Graffiti removal involves chemical treatment and controlled pressure. Because surfaces are already damaged:

Some shadowing or “ghosting” may remain
Treated areas may appear cleaner than surrounding surfaces
Full exterior washing is not included unless specified

17. Glass Restoration

Glass restoration involves controlled grinding and polishing.

Optical distortion will occur and varies based on damage depth
Edge damage cannot be removed due to sealed glass construction

18. Anti-Graffiti Coatings

Anti-graffiti coatings are sacrificial, not permanent barriers
Coatings must be reapplied after graffiti removal
Coatings do not prevent graffiti adhesion — they only aid removal
All graffiti removal and reapplication must be performed by RGR Power Washing

19. Limitation of Liability

To the fullest extent permitted by law, the Company’s liability is limited to the amount paid for the services performed. No liability is assumed for indirect or consequential damages.

20. Indemnification

Client agrees to indemnify and hold harmless RGR Power Washing from claims arising from:

Failure to disclose site conditions
Unsafe property conditions
Client or third-party negligence

21. Dispute Resolution

Disputes will first be handled through good-faith negotiation. If unresolved, disputes shall be resolved by binding arbitration in [State].

22. Governing Law

These Terms are governed by the laws of the State of [State].

23. Severability

If any provision is found unenforceable, the remainder shall remain in effect.

24. Entire Agreement

These Terms constitute the entire agreement between the parties and supersede all prior agreements.
